In early, 2020, the Superior Court formed the Model Jury Instructions Committee to create official, plain-language civil and criminal jury instructions for use in the Superior Court. The Superior Court has published a set of Guidelines for drafting plain-language instructions; templates for civil and criminal empanelment with both individual and panel voir dire options; templates for civil and criminal pre-charges; templates for civil and criminal final instructions; and instructions from some common civil claims. It has published (as of July 2021) criminal instructions for assault, various forms of assault and battery as well as assault and battery with a dangerous weapon, and mayhem. It expects to publish more instructions soon for other common violent and sexual crimes. This program is an excellent opportunity to learn about the new jury instructions from the judges who authored them.

  • Overview of Guidelines and criminal empanelment, pre-charge and final scripts
  • Overview of criminal instructions published to date, and what is to come
  • Panel discussion on how practitioners can effectively use the instructions
  • Q and A

The jury instructions are available at: https://www.mass.gov/guides/superior-court-model-jury-instructions .  The Superior Court welcomes input from practitioners regarding the instructions.  Information about how to comment may be found on the website.
