The distinguished author of the American Bar Association best-selling book
Reinventing Witness Preparation: Unlocking the Secrets to Testimonial Success
Kenneth R. Berman, Partner, Nutter McClennen & Fish LLP

Kenneth Berman, book author and columnist for the ABA’s Litigation Journal, will offer this eye-opening video webinar covering transformational approaches to witness preparation and advice on establishing credibility and persuading decision-makers.

In the first part of the webinar, the author will present his engaging TED-style talk: “Anatomy of a Cross-Examination Disaster (or Triumph),” showing how easily a crafty cross-examiner can lead a witness, even expert witnesses, into giving terrible answers and how changes in witness preparation can turn the tables in the witness’s favor.

In the second part, the author will present another engaging TED-style talk: “Persuasion, Credibility, and the Real burden of Proof,” exposing the myth of the neutral adjudicator, revealing why the litigation playing field is seldom level, showing how hidden brainwork silently alters the burden of proof, and teaching what to do to overcome these roadblocks to victory.

In the third part, the author will take questions and offer advice on any or all of the above.

“Kenneth Berman’s Reinventing Witness Preparation challenges conventional thinking and upsets orthodoxy by providing a new template for one of the most important aspects of law practice. Every litigator needs to read, and learn from, this outstanding book.” — Steven Lubet, Author, Lawyers’ Poker: Fifty-Two Lessons that Lawyers Can Learn from Card Players; Williams Memorial Professor; Director, Bartlit Center for Trial Advocacy; Northwestern Pritzker School of Law

“Reinventing Witness Preparation by Kenneth Berman is a valuable addition to every litigator’s bookshelf and should be required reading before your next deposition or trial. Berman makes and illustrates his case thoroughly and thoughtfully.” — Thomas A. Mauet, Author, Trial Techniques and Trials; Milton O. Riepe Professor of Law, James E. Rogers College of Law, University of Arizona

Kenneth Berman’s book, Reinventing Witness Preparation will be shipped by the ABA after the program date. The price has been discounted substantially from its regular price of $65 and includes tax and shipping.
