Day 1: Pre-Nuptial and Decanting as Tools to Protect Inheritance Expectations

- Trusts are vulnerable to division in divorce, even with spendthrift clauses. Indeed, marital exclusion language, ascertainable standards and other clauses are insufficient to protect Trusts against inclusion in the marital estate for the purpose of equitable division of property.
- Only through the use of Prenuptial Agreements can trusts be adequately protected from division in divorce.
- Decanting can protect an otherwise vulnerable trust in the context of prenuptial planning by strengthening and changing terms that create vulnerabilities and exposures due to the recent evolutions in case law relating to the divisibility of trusts in divorce.

Day 2: Post-Nuptial and Holding an Impacted Marriage Together
Date & Time: Tuesday, October 18, 2022 – 4:00 pm – 6:00 pm ET
- Postnuptial agreements can be used to save a marriage that is pressured by a spouse’s addiction, mental health, gambling, gifting, debt exposure, recklessness and extramarital conduct.
- By shifting assets in accordance with the terms of a prenuptial agreement, spouses can remove certain pressure points from the marriage and work to stay together.
- Postnuptial agreements are reviewed by the Court with a heightened standard due to the propensity of these agreements to be tainted by claims of coercion and duress. Certain proactive steps can and should be taken to bolster the enforceability of postnuptial agreements.

- Diminishing capacity of divorced or widowed aging parents creates an opportunity for and vulnerability to financial exploitation and undue influence by a new love interest.
- Litigation, whether in the form of protective service proceedings, guardianship/conservatorship, equity actions for declaratory judgment and/or Will Contests and Trust litigation, are common battlefields in these sensitive fiduciary litigation matters.
