First presented to Massachusetts judges by the Flaschner Judicial Institute, this CLE on Motions to Suppress has been adapted for both defense attorneys and prosecutors who practice in the District Court, Boston Municipal Court, Juvenile Court and Superior Court.
Four judges seasoned in the criminal sessions will survey the nuts-and-bolts—as well as nuances—of
• stop and frisk;
• search and seizure;
• probable cause based on informant evidence;
• Miranda and voluntariness of defendant’s statements;
• and motions to suppress based on impermissibly suggestive identifications.
The panel will also discuss practical management issues, such as scheduling, hearing procedures, and the requirements for a proper motion and supporting affidavit.
