the Juvenile Delinquency/Youthful Offender, and Adult Criminal Trial panels.
Judge Rooney and Judge Barretto will reprise a program that they presented to District Court judges earlier this year. Using a series of hypotheticals that illustrate both common and complex situations they encounter in court (with answers included in the materials), as time permits they will cover such topics as:
- Motions for a New Trial based on ineffective assistance of counsel for a wide range of issues, including immigration consequences, newly-discovered evidence, failure to produce promised evidence, conflicts of interest and failure to file pre-trial motions.
- Motions to Dismiss for violations of a defendant’s speedy trial rights, and discuss proper sanctions for discovery violations up to and including dismissal of the case. They will also discuss motions to dismiss when the Commonwealth answers “not ready’’ for probable cause.
- Mechanics of Motions to Suppress, including what is required in an affidavit, motions to sign affidavits late, oral motions to join by co-defendants, and ability to allow or deny a motion without a hearing, as well as the options that are available to the Court when no motion is filed or witnesses fail to appear.
