This is an encore of a program that Judge Swan and Judge Hand presented to District Court judges. They will examine the structure of a civil case in the District Court with particular emphasis on procedures that are typically encountered before, during and after trial – filing and service, case management and pretrial conferences, nisi dismissals (Joint Standing Order 1 04, s. V.B), motions subject to opposition procedure (Joint Standing Order 1 04, section VI (D) (3), pretrial remedies (attachment and trustee process, with a brief mention of TROs and preliminary injunctions), dispositive motions to dismiss (Mass. R. Civ. P. 12 (b)) and for summary judgment (Mass. R. Civ. P. 56), discovery sanctions (Mass. R. Civ. P. 37), continuances (Mass. R. Civ. P. 40), dismissal of actions (Mass. R. Civ. P. 41), directed verdict and judgment NOV (Mass. R. Civ. P. 50), findings (Mass. R. Civ. P.52), and post-trial motions for new trial (Mass. R. Civ. P. 59) and relief from judgment (Mass. R. Civ. P. 60).

The course will discuss how lawyers in the District Court should approach each type of procedure and what District Court practitioners must know to succeed.
