This seminar will examine practical lessons learned from what went wrong in the case of United States v. Ted Stevens, which ended in a guilty verdict that was vacated five months later at the direction of a new U.S. Attorney General. Upon dismissing the case, the presiding trial judge stated that was the “worst case of prosecutorial misconduct” he had seen during his career. The case resulted in over 1,000 pages of investigative reports by both the Justice Department and a court-appointed special prosecutor. There are many lessons to be learned.

This seminar will be taught by one of the principal defense lawyers at the Stevens trial and will present vital lessons from the litigation, focusing particularly upon Brady requirements and discovery-related motion practice.

Topics covered will include:
• the use of pretrial discovery requests and motions;
• how to make a record of discovery failures before, during, and after trial;
• how to advocate for justice after a verdict you believe to be ill-gotten has been rendered.

Time will also be devoted to the role that the Rules of Professional Conduct play in insuring justice in our courts.

Included in the price of enrollment is a copy of Mr. Cary’s book, Not Guilty: The Unlawful Trial of U.S. Senator Ted Stevens, which has been described by retired federal judge Nancy Gertner as “an extraordinarily important book, a must read not only for lawyers, but federal judges.”
